These Terms of Service ("Terms") govern your use of the Guitarclimb mobile application ("the App") developed by Guitar Climb LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.
1. Acceptance of Terms
By using Guitarclimb, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
Guitarclimb is a guitar learning and practice application that provides tools including a guitar tuner, fretboard visualization, chord library, rhythm practice features, and progress tracking. The App is designed for educational and personal practice purposes.
3. Subscriptions and Payment
Guitarclimb offers auto-renewable subscription plans:
• Monthly Plan: Billed monthly at the price displayed at the time of purchase.
• Annual Plan: Billed annually at the price displayed at the time of purchase.
Free Trial: New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
Billing: All payments are processed by Apple through the App Store. Your Apple ID account will be charged at confirmation of purchase and upon each renewal period. Prices are displayed in your local currency and may vary by region.
Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID account settings.
Refunds: Refund requests are handled by Apple according to their refund policy. We do not process refunds directly.
4. License and Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms and Apple's App Store Terms of Service.
You agree not to:
• Copy, modify, distribute, or reverse-engineer the App
• Use the App for any commercial purpose without our written permission
• Attempt to circumvent any subscription or access restrictions
• Use the App in any manner that could damage, disable, or impair its functionality
5. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, user interface design, audio synthesis, scale data, chord data, and pattern data — are owned by Guitar Climb LLC and are protected by copyright and intellectual property laws.
The musical theory information presented in the App (scale intervals, chord voicings, standard tunings) represents commonly known musical knowledge and is not claimed as proprietary.
6. Accuracy and Disclaimers
The App provides tools to assist with guitar practice and learning. While we strive for accuracy:
• The tuner provides pitch detection as a practice aid and should not be relied upon as a professional-grade calibration instrument.
• Musical information (scales, chords, patterns) is provided for educational purposes. We recommend supplementing App-based learning with instruction from qualified teachers when possible.
• The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Guitar Climb LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of or inability to use the App.
8. Termination
We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms. Upon termination, your license to use the App is revoked. Sections regarding intellectual property, disclaimers, and limitation of liability shall survive termination.
9. Changes to Terms
We may modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the App after changes constitutes acceptance of the modified Terms. Material changes will be communicated through the App or via the App Store update notes.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Wyoming without regard to conflict of law principles.
